I think there's an old lawyer saying that "Possession is 9/10ths of the law". The vehicle may be yours on paper, but as long as you have not taken physical delivery of it, there is still room for re-structuring the deal such that you get an un-damaged product (which is what you paid for). As soon as you get in and drive it off the lot, all bets are off.

Anyway, you got nothing to lose by trying. Stay calm and go through the process. At best, they will take the "fixed" X5M for themselves (they'll write it off as a floor model and/or demo model) and then get you a new allocation. At worst, you will still wind up with this one, but you'll have made such a big stink about it that they'll have to concede on other things, like custom-extending your warranty and service to 75,000 miles (not a bad thing to ask for in light of "damaged goods").

Well, it took the past 2 weeks but I got a fair resolution. At my continued request, the dealership that I purchased the car has taken the car back and put my name on another car that will start production any day now - configured exactly like the damaged car. Although it has been a very stressful process, I am pleased with the outcome. Both the dealership and BMW stepped up to take responsibility for the problem - I am pleased with this. At the same time, I will probably get the next X5M sooner within 4-6 weeks now. Thanks for all your suggestions.

those radiator fins are really soft. i bent a few just using a garden hose and with a "stream" setting. never do that, always use "spray"

Awesome! Happy for you. Just hope they use the other car as a demo and don't give it to one of US now...
