Advice Needed Insurance Wants to Total Car Dinan 4.8is

So two weeks ago my car was hit parked. A car ran a stop sign and was t-boned into my car. My rear bumper, rear tail gate(top & bottom), tail lights, and right dinan muffler were impacted. None of the damage was serious but enough to make everything unacceptable to leave as is for my standards. So bodyshop puts together an estimate of 5600 to get the car good as new. I'm satisfied. Then insurance comes in and has him cut off the repair at 2900 otherwise they will total it due to the value of these things. Estimate is using aftermarket rear bumper, used tail lights, etc. I really don't want to total the car out. I am at zero fault here. Car that ran stop sign is 80 the car that t boned him is 20. Car is running mechanically like new. Currently sitting at 98k miles Full Dinan Stage 2, Brembo BBK all around, underride kit, European Clear headlights, Euro Fender Flares, Completely upgraded sound system with stealth sub, etc. All original paint on car. I wouldn't sell the car for less then 15k. What do you guys recommend?

Do what you have to do to keep this car on the road and not be totaled. It may cost you.

Work with the body shop - have them bill the Insurance Co $2900 and you pay the rest
- maybe you can seek reimbursement from driver at fault in small claims.

Negotiate with insurance Co and show them comparable values. 4.8is' are going up in value. See if they will raise their payment...

You could explore having the Insurance Co. total your car and attempt to buy it back, BUT I don't like the idea. Your car will then have a salvage title.

Sorry to hear that John! When I got your email I figured it was a simple bumper, maybe lower tail gate replacement. I hear this situation at least twice a year on the different auto forums where auto insurance companies try to total out enthusiast vehicles for blue book values.

It always takes awhile to get sorted and causes a lot of headache. I'm assuming the insurance you are dealing with is the 80yo's? Pick whatever number you would be satisfied with getting from them plus you keep the vehicle. If that number is $5600 + the X5, then stick to that. You might have to get an independent appraisal done as well. And come up with your own market comps to show the insurance company. They will make you work for your $$$. But you are due the money, so work towards a resolution you will be satisfied with. An attorney might need to get involved (and tell the insurance company as much) if things really go sideways. Good luck with it, keep us updated, if you are legally able to. Sometimes at final settlements you will not be allowed to disclose certain details.

If you still carry collision and comp on your car, get your insurance company to fix your car and let them go after the other guy insurance. If your insurance company wants to total the car work with them to get your best deal and tell them you want to keep the car as part of the deal. Find a garage that will work with you on the repair. Or keep the car and sell the car to a member on this forum.

If you have invoice records of these items (especially the BBK) and any significant repair history show the insurance.
While your policy was likely written without consideration for factory / aftermarket add ons, you can use those items to establish an "above" market evaluation since all E53 values are in the toilet at the moment.

Only issue is, you probably wont find a dinan exhaust, that was NLA long ago. As low value as E53's are, used parts are still expensive...weird huh?

Since you're not at fault pressure the insurance to go after the other co.. Hopefully they are not the same!

You need to go back to your insurance company and demand more. I just ran your truck through KBB and $3992 is the low end and $7177 is the high end for a vehicle in "very good" condition. For "excellent" which it sounds like you could argue, it's $4261 to $7662.

I hate insurance companies. They're effing thieves. Go get two more quotes and then shove it up their a** along with the KBB info.

Never settle for the initial offering of payment. Especially if it is not your company you are going through. As said find comps to boost the price to the real value of your car. Actual replacement of your car is what they should be offering especially since the car was parked and you are the victim.

Actually, insurance companies have to look at comparable, not just KBB. In your case its a specialty car so that could mean a larger search for comparables.....you need to do your own research on comps to present them so that you can convince them to pay the 5K to fix it vs salvaging it.

Hope you have your Dinan receipts as the bolt on items can likely be claimed against the other company but it will be harder to do so on yours.

Depends on how much the vehicle means to you, only you can measure that No one can answer that for you.

That said, if there is no damage to the suspension $2,900 is not that much if the vehicle can be sold for $15,000 when repaired.

Sometimes a body shop will reduce the price if they can take their time getting it repaired or you wait until business is slowfor them. However, the longer they have it the more risk you take that it will be further damaged at the body shop. I would at least get repair quotes from other shops in the area.

Don't buy if from the insurance company to part it out unless you have tons of time and can keep it somewhere for many many months. It's not as easy as it sounds on the surface.

Some states are no fault states. If so, there will be no clause in your policy for subrogation. Depending on state laws it might be possible to file a civil suit but attorney fees will take a chunk of it.

If you fix it and keep it, I would consider a stated value policy.
