OH, I see. You are saying that she was not there at all (you had been stopped for ten seconds).

And she came along and smacked the rear of your car. And it was partly her fault because she didn't blow her horn before she hit you.

need some pics, but i was recently quoted close to 2000 for a full replacement of a 4.8is bumper, this included the push bar and shock absorbers...

Seems like a 50/50 thing. Since you were going backwards and hit her and she was moving forward and she hit you.

thanks for the responses everyone, ive decided since i wanted to get chrome tips anyway that i will be ordering chrome tips and i have chips on my hood and some minor scratches on the car ( it is an 01 after all) ill have the car resprayed, my mechanic advised me that i do not need a new bumper.

If she does file an actual accident report (not a hit and run) then he can just change his story too. No police report on site is his word against hers. His insurance company will deny her claim against him.

Just remember, if you're in an accident and its not your fault. Call the cops immediately on site. If it is your fault, then let the other driver call the cops. Of course if the accident is serious and has injuries then call the cops immediately regardless of who's at fault.

Except in California, for non-injury accidents, where both parties have valid drivers licenses and insurance information police are only responsible under law to help facilitate the information exchange. Generally no report is taken for a non injury accident and the question of fault is left to the insurance company. It has even gotten as far that some police departments WILL NOT respond to the scene of an accident if no one is injured and the information is being exchanged..

Wow. I bet thats a real mess for claims adjusters to try to figure out...

I think thats part of the thinking... put it to the claims adjusters rather than the cops..

I back into a stop car in parking lot in my new car.

The car pulled in when I was not looking and it was a black car at night.

Anyway, the car I hit had a small dent behind the left rear wheel. She got a estimate for $350 and a paid for it out of pocket. I figured it was better than claiming it.

Sorry for your bad luck.
