warranty issue
The dealer denied warranty coverage on the power door lock acutator and the harness attached to it because the door was painted. I took it apart and its pretty obvious that the window caught the cable when coming down and yanked the wire causing the connector on the part and the harness to break. The way they described it to me is that it was beat on. Now, why isn't that covered by warranty I wondered. I called up the service manager and he didn't deny that the wire was caught by the window. Instead he asked me how the wire got in the way of the window. He says that when they painted the door they may have not put the wire back in the right place. I told him I don't even know if the body shop ever took the door panel off and if they did whether or not they put the wire back correctly. I told him that is was pure speculation to blame the body shop who painted the outside of the door and that pure speculation should not void the warranty. Its equally possible that I hit a bump in the road and the wire got loose. Its held away from the window by a little flimsy plastic part. Anything could have caused the wire to move in the door. He didn't budge so I asked for the phone number of BMW and filed a claim there. They will now call the service manger and then get back to me. Any advice? Everyone pitch in. Dom |

Go to another dealer, ask them to cover you under 'goodwill' (gotta maintain the good BMW name), and if the SA is good to you, have a Starbucks gift card handy to slip to him/her.

These guys are grabbing at straws, I would talk to the shop manager first, then if I got the same response, go to another dealer.

In my experience, it is standard practice to try to first put the blame on the last guy that touched the car and could have caused the problem. It would have to be proven that the last guy did not cause the wires to get caught by the window or did not take the door apart - which a good shop would probably do (affidavit or ??). If it did happen that way, that shop's insurance should take care of it. Until that is established, it is not fair to expect the dealer/BWM to eat the cost of damage that someone else caused. Good will only goes so far and why should the other guy get a walk?

From what I can see the body shop did not remove the door panel at all. They merely removed the handle which can be done without ever getting near the wire in question. Would you opinion change with this information?

I still don't understand why the customer has to prove this. I think that BMW should prove it

Furthermore, I don't think you can prove a negative anyway, can you?
I'm going to take them to small claims court and we'll find out the answer. Dominic |
