2011 30D feels like its slipping between front and rear wheel drive

Hi, I bought a 2011 x5 30d 3 weeks ago but have hardly used it until last week when i took it on a bit of a road trip. Until then all my driving had been on country roads up to speeds of 50mph. On the trip last week when on a motorway and accelerated from 60 to 70+ there was a noticeable splutter as if it had a misfire. I then noticed that it got worse when going uphill on cruise control.
Having read all sorts of forum posts I am now thinking it might be the transfer case. When I turn tightly in a parking situation I can feel the tyres working against each other as I used to on my Vitara 20 years ago. At first I thought this must be normal on an X5 but the forums say otherwise.
What do you all think?
It was bought from Evans Halshaw not BMW, has a 2 year warranty so I could try to go that way and get it repaired and as yet I have not told them about the issue.
I love the car but I am now worried in case there is a significant bill round the corner.

My X5 did the same hesitation thing 2+ years ago. It did not do the tight turn issue unless I pressed hard on the gas. The dealer said I needed a new transfer case. I noticed the i-level (software for the car) was from 2009. An EGR recall from 2011 required new hardware, which I had, along with new software, which I did not have. After full i-level software update, X5 has been good as new. The US EGR is different from the rest of the world so this may not be your issue.

Take your key to the dealer and ask for a key read to determine i-level. Or install ISTA+ to read it yourself.

I've been back to the garage I bought it from and booked it in for investigation. Not sure how well they will get on as it is a Citroen dealer. They are part of Stratstone group and have a premium retailer over the road so they said it will probably go over there or they have a BMW specialist available on the 29th if required.
I am hoping that it might just need a software update and transfer case fluid but we will see.
I don't want to return the car as I have transferred my registration plate and spent some cash updating the wheels and badges etc.
I will post the outcome once I know.

So, been back in today and it’s been taken to a BMW specialist. The garage now says the issue is down to different tread depth front to back, 7mm front and 3mm back. Thought I was going to have a fight on my hands but they are putting some mid range tyres on the rear for free. Not sure if this will solve the issue but I may as well wait and see if it does the job.

utter garbage- a 4mm tread depth will not cause any issues.

I mean now it is 7mm up front an 10mm in the rear...how come THAT isnt 'the problem'?

Did they do anything else? Reset anything?

As far as I know they have not done anything else.
Getting annoyed now though, the car is driving worse than ever, they managed to do 100miles and use 1/4 tank of fuel in the process.

Have they pulled the fuse for the transfer case and driven around in 2WD?

They haven’t told me what they’ve done, only what they have diagnosed and what will fix it e.g. new rear tyres. I have seen another post on here with a similar issue where tyres did resolve the issue, all I am worried about now is has the damage already been done and will this happen again as soon as the tyres wear a bit?

Shitty situation. I highly doubt it’s the tires, but you have little choice now but to change them in order to prove it’s not the problem. If you do, tell them you’re keeping the old ones to put back on if they’re wrong. I had a shifting issue at one point that my dealer claimed was related to the tires. It wasn’t until the car started taking five seconds to shift into reverse that they acquiesced and replaced the trans.

So, new tyres on the rear and no better, probably worse. Too the mechanic out in the car and he felt it straight away. He didn’t think transfer box but he is a Citroen mechanic and not a bmw one. Evans Halshaw tried to book me back in for the 11th and I told them I was returning the vehicle. They then managed to find me a slot and a loan car for Monday to take it back to the specialists that suggested the tires were the issue. I am starting to think this is a waste of my time and I should go back to Volvo and get another XC90.
