Agree that the preferred option is to have the dealer go to bat for you, but I'd already brought it to my indy who had diagnosed it. I shared the full diagnosis and codes with the service manager at the dealer, and he said "BMW won't cover that out of warranty, and the total out the door price at the dealer is $7,600". My indy had done a preliminary estimate close to $5K. As it turned out, they came in a few hundred below $5K.

Still very disappointing that BMW didn't stand by the brand given that the turbo failed at such low miles. We all know they ended up having to extend the warranty to 8 years/82K miles on the N54 engine. We'll see whether they get enough failed N55 turbos that somebody files another class action lawsuit.

Ive read a couple of hundred thousand posts...We don't see turbo failures. I cannot imagine this ever being a covered issue or class action. Just not enough reports.

The turbo is in fact covered by the California warranty- 7/70k- if I recall. Of course Georgia is one of those states that help reduce pesky regulations and support businesses. So you are SOL

I'm not sure who "we" are, but while trying to save as much money as I possibly could on this disaster, I found about 20 or 30 legitimate sellers on ebay selling refurbished N55 turbos as well as your usual ecstuning.com, turnermotorsport.com and other familiar vendors in our community selling refurbished N55 turbos. Also, my dealer service manager told me that it's not uncommon to see failed turbos at more than 100K miles, but they also see them at 35K and 40K miles as well, although less frequently.

There wouldn't be a big market for N55 turbos if they didn't fail. The N54 turbo warranty extension was part of a settlement of a class action.

Stories like this is why I prefer to buy high mileage well maintained vehicles than low mileage ones. Even with maintenance. Cars need to be driven.

Crappy break. But I don't think this is class action material. Call a lawyer though, I could be wrong. Failures would need to be in the many thousands or tens of thousands. BMW does make mistakes: IE e61 rear hatch electronics being water damaged. Class action was settled for that.
