Gas leak Aircontioning please advice

My X5 E70

After the winter was over we started the AC and I noticed it was not cool, checked 21 Oct. with BMW in Adelaide and found gas level low and gas was refilled with and colour indicator in it.

Went back 14 Dec and the yellow colour indicated the gas leak in the evaporator.

The total cost for the repair is estimated to be A$ 3000.- as the car was just 100 days out of the warranty I was promised no parts cost A$1500.- but not the labour cost A1500.00 and the gas cost A$ ??

Now the new gas is in we noticed that the AC has never been so cold and we have the strong feeling that the unit has been leaking for a long long time and well before the end of warranty, perhaps from new.

Now to come to the point:

Car warranty end 13 Juli 2010
Gas leak confirmed by BMW 21 Oct 2010 , so 100 days after the expiry of the warranty.

My intention is that I drive the car for for a period longer that 100 days say 130 days and when the AC is still cold , so there is still gas in the unit I proof that the leak started well before the expiry of the warranty period.

I am not sure whether BMW will accept this, if not what to do, I must admit they are nice people with a good service.

Any advice is appreciated

I do not know Australian laws, but in the U.S. you'd be out of luck if you are out of warranty 100 days and had nothing noted in the service records of problems before the warranty ran out. 10 days would be a good case, but 100 days is starting to get out there a bit.

If you push it, you might get more good will out of BMW, but it sounds like a typical BMW approach of providing the part for free to the dealer, but not wanting to reimburse the dealer for his labor costs. I would probably try to get some good will from the dealer and politely, but firmly, ask him to join in and provide a lower labor charge, e.g., suggest that you'd be a likely customer of theirs next time around if you'd do it for $500, and see if they come up with a counter offer of perhaps $750 or $1,000.

But that's just my approach, I am sure others would advise a more aggressive approach.

Car details : X5 E70 Number plate : SEA 90 N
Warranty expiry 13 July 2010
Gas leak detected 21 Oct 2010 Days out of warranty 100 days

The evaporater leakage is a common X5 problem so before the end of warranty have the gas checked and if low refill with a color dye and check two weeks later for leaks

8 months later my condenser was leaking and replaced @ cost of 2000 $ now 6 month later again my aircon compressor has packed in and i have to wait for 3 weeks for a new one at $2200.-
I think that this stinks i think that after replacing the condenser they may have not filled the system with oil for compressor lubrication, I have no proof!!!
I get a X1 replacement car for free for the 3 weeks
To be honest i am getting tired with the BMW problems , where can i go ?? for sure the Lexis/Toyota quality is much better !!!!!
