Our 12 X5 was rear ended by uninsured.

It happened last Saturday, we stopped on freeway due to the traffic, and a 95 Camry rear ended our X5, the driver either didn't keep safe distance or he may be distracted by something.


My wife and two boys(3&5yrs, both in car seat) were in the car. I quicked checked my boys after accident, my 5 yrs old looks fine, but the little boy cried like crazy, it worried me since I am not sure it's due to the shock or injury, we called BMW assist, the ambulence and police arrived quickly.

The firefighter checked my boys and they thought both were fine, but they found one of my finger was bleeding and gave me a bandage, I was not sure what happened but it's not big deal to me.


The cop took our information but didn't asked us anything and then talked to the driver who hit us for quite a while, finally the cop came back to us and said that the driver doesn't have insurance, no driver licence, and even no ID, he could give the driver $2000 fine but doesn't bother since he may lied on his name, the computer ran his name and came up nothing. What he could do is to let him go.


It doesn't make any sense IMO, the cop at least need to tow his car to keep the street safe since that drive didn't even have driver licence and the car is known uninsured. What can stop him, until someone got killed?

Our X5 is in the shop with total 4.5K damage, my insurance will take care of it with my out of pocket cost of the deductible, my other loss would be the diminshed value, I am OK with that, I am even glad since none of my family member is injured during the accident.

Sorry to hear that!! It appears the police did not believe it was worth the effort to tow the idiots car but like you said just be glad no one was hurt. Good luck.

That doesn't make any sense. Over here they would of impounded the vehicle (because ur not allowed on the road with no insurance.. Unless the laws in ur state r different) and they would of detained the driver at least until they can figure out who the hell he is. He could be a wanted felon for all they know lol

so the cop said he wouldn't issue a ticket why?

the wife just got hit by an Impala while driving her E90. $6500 damage and the cop said he wouldn't ticket the fully insured woman unless we wanted him to write one. we declined.

The cop may think it wasting his time to issue a ticket to someone without ID.

Cop should have arrested him on suspicion of giving false info... At the very least booked, photo and prints.


Makes me- and others that pay taxes, buy insurance, and generally play by the rules- really feel like a patsy, no?

WTF????

in NY this guy would have been thrown in jail and his car towed...

he could have been a murderer or some criminal on the run with a warrant out for his arrest.. don't the cops think about that anymore??

this make me mad.. i want to go down there and beat the crap out of someone... this sucks.. he gets away free and you pay out of pocket..

thank God you and your family were ok... but he needs a serious beating!! and so does the cop!

In Ca., the officer would have likely arrested the driver for being unlicensed and then booked him as he had no valid identification. That way they could run prints and verify his info.
And also would have given him an additional charge of driving without proof of insurance at the scene of an accident.
They would have also towed the car with a 30 day impound for being uninsured. If the owner of the car is other than the driver, the reg owner could contest and receive a hearing to get car out of impound early.
This is in certain cities, not all of Ca. Oakland for instance, where the cops are literally responding to murders and shootings everyday, they wont respond to accidents if there are no near life threatening injuries.
