By the way this is a pampered car that has had a good life...........replaced the valve seals, said they were all worn and cracked pretty bad.........this would end up being a recall...........

Are you 1st owner, or 2nd owner purchased from BMW with CPO? Has all prior maint/oil changes been done by a certified BMW repair center?
If that's the case, you could have brought the vehicle to a BMW repair center and requested the repair be a partial goodwill.
If BMW can verify they have done all maint/oil changes you would have had a chance.
BMW won't do a goodwill repair if they can't verify ALL maint/oil change records. Some owners & Iffy Lube shops use unapproved oils and/or whatever oil is cheapest (go 15k miles on a non-longlife/extended life oil and things can go bad quick).
