I would be worried about the cluster. Could be a sign it was opened for some reason. One of the biggest surprises when I bought mine was discovering someone had pried off the trifecta warning lights (soldered on LEDs, no bulb to remove) rather than fix the DSC module. Scanning for codes is a must.

People don't "forget" to install intakes. If so, you get a call and go back the next day or the mechanic brings the parts to your house...

Get a good independent inspection from someone that can pull all the BMW codes.
