Maybe you can cancel your warranty for a pro-ration?
There is a BMW diesel performance shop not far from you that may be able to help you better than the dealer can. Stay away from the guy who sold you the car unless it is to pick up a check to pitch in toward repairing their botched repair. Legal recourse could be appropriate if he tells you to pound sand. Not my dept.
If the rest of the car warrants it, just fix it. Do all the other "while you are in there or close stuff." If its better to cut your losses and start with a different car, do that.
This is not an inexpensive car to keep on the road, but is incredibly rewarding to drive when is running right.
I would be wary to drill or tap in that area to avoid metal shavings in exhaust.
