Driver's side must have been replaced.
The axle nut is not very hard material. the hub is press-fit with a gagillion psi into the bearing it will not be a problem of you nick it when cutting off the nut.
Since the axle is being replaced through it will shower with sparks the easiest method would likely be to cut straight through the axle with a right angle grinder. You may need to use a smaller diameter than new blade to get deep enough and that rusted you may need to cut into quarters to remove.
That is an amazing amount of rust. There isn't that much rust on my entire 17 year old E53! Not exaggerating
