Can't same-sex relationships (regardless of marital status) simply sign medical POAs and be designated as health care surrogates? For instance, my mother, who had a left CVA, signed a POA giving my brother and me pretty much total control...who's to say she could not have designated a female who is not a family member?

Am I missing something? Isn't the whole discrimination thing a red-herring?
