They already are - it's not like they are failing crash tests left and right. But - why aren't they the safest? Because that would add expenses and development time. From a business perspective it makes sense to compromise somewhere, in order to get a competetive product out in a timely manner. Hard to fault them for that, no?
Audi, BMW and Merc all have different aproaches that lead to different atributes being favored in various degrees. BMW favor design and handling somewhat over safety. Audi might do it the other way round, while Merc forego the handling somewhat. Those very differences are what give these cars their unique feels.
