bump...
I never did find the leak as it "went away...."

but as of Saturday noticed it was leaking again from the same spot. So I decided to bring her in today to get it fixed! Later today service calls me up and says it’s leaking from the "mechatronic sealing sleeve." Also covered under CPO


seems it’s a known problem found this Bulletin today on the web



BMW: 2000-06 X5 WITH AUTOMATIC TRANSMISSION
SUBJECT: Fluid leaking from the transmission oil pan may be caused by a faulty O-ring and/or a faulty "mechatronic sealing sleeve." The sleeve and O-ring can be replaced after removing the transmission oil pan, and the bulletin includes basic instructions and all the part numbers need for the job. The original transmission fluid is specially formulated for BMW transmissions, so it's important to use the correct fluid for refill. Bulletin SI B 24 08 06
