i cant believe the contractor wants any of the money...try putting this in another context ..

you buy a used car ...you take it to be valleted...the valleters find an ipod under the seat that the previous owner had....is it now rightfully theirs?

the contractor wants to be happy that he was hired to do the work in the first place the ungreatfull sod!
