Sex law remains on books
State lawmakers tried, but failed, to limit the North Carolina sodomy statute, which penalizes consenting adults. The sodomy statue states that, “If any person shall commit the crime against nature, with mankind or beast, he shall be punished as a Class I felon.” The law, which applies to both homosexual and heterosexual couples, defines oral and anal sex as felonies, with a presumptive imprisonment of two years. State Senators Ellie Kinnaird and Jeanne Lucas introduced The Sexual Privacy Act to exempt consenting adults from the sodomy law’s reach.
