Why would you buy a car that you had already leased and had so many issue with?? DUH!! NOw you're complaining? Sorry I don't get it. YOu should have left that problem with the dealer when your lease was up and got something else.
As far as your "lega issue" goes. In the legal worrls, there issomething called discovery. This is when on or both sides of the legal table gather all of the facts concerning the pending case and determine if 1. they even have a substantial amout of data to warrant a claim or counter claim, and 2. if the outcome of the case is going to warrant the financial burden presented byt litigation.

I dont know exactly what your long term goals are, whether you are after payment for the isuues, or a new car or what but on the surface it looks like a win win for the dealer, your lawyer and BMWNA.

I'm guessing you should cut your losses and get your car to someone that knows how to fix it. You are wasting your time with that dealer and will get nothing in return in terms of litigation I would pretty much bet on that.
