At any rate, I feel fairly certain that they looked at the programming issue. They said this step was to document the issues for the future in case there was a failure. I'm out of warranty now so I expect that there will be nothing covered if it fails.

What they did to bring the engineers in the loop was an email based tech line support called PuMA. Which means this is all well documented as to what they did and that this is a continuing problem from within the warranty period.
Now that the issues are more defined and consistant I'd bring it back in. Odds are they may replace the transmission, and should do it under the goodwill policy as the vehicle is just out of warranty, low mileage and a pre-existing problem from when it was in warranty. And once she is fixed, she will run like a new ride again allowing you to fall back in love with her!
