If it is the battery in the FOB going bad (which they do over time) then unfortunately you're still going to have to pay the $$$ for a replacement key. Another dumb decision by BMW not to permit replaceable batteries in their FOBs, though if someone had the desire they could dremel off the back of the FOB and solder on a replacement battery...
