With both the US EPA tests and the EC tests, the car is not even driven on the road. The tests are carried out by the manufacturer and/or distributor on a dynamometer to a standard set by the government authority in question. Here in Australia we also use the EC test standard and in the real world it's very hard to replicate the EC figures whether you're driving a BMW diesel or a Toyota Hybrid, or anything in between.
