If that was true, then the pads would be quiet in Canada and other regions where four year included maintenance doesn't include brakes or wear items.
I believe that the hard (and thus noisy) pads have more to do with fade resistance and a heavy vehicle in this case.
Must be very frustrating. I would keep going to the dealer until BMW incurs sufficient warranty expense to make a change in the pads or caliper.
