Thought I'd give the resolution;

This was the third time in for the problem and they wanted to make sure they nailed it so they pretty much rebuilt both heads under warranty, $6K billed to BMW. Intake levers, intake rockers, o-rings, pushrods, eccentric shafts, injectors, plugs (again), coils and other items, but you get the gist.

They really went through motor, compression checks and numerous other items to rule out other problems.

Once again, thank goodness for the CPO warranty. Now the only problem is I had so much fun with the 2010 328i x drive ...I want one. Handled very well in our ice storm a few weeks back.
