Toyota has found that taking your approach doesn't work well in the longer-term.
I guess, if this happens about 50 more times and gets media attention your position that this is anything like Toyotas recent debacles, that may hold merit. However, I'd highly doubt it. BMW has had SERIOUS issues with its fuel pumps in N54 motors and that is barely a blip on the radar. Again, if they can't re-enact what is described, they aren't taking it at one hundred percent accuracy and they shouldn't. Leave the car on the side of the road when it has a problem and tell them to come get it, then they may take it seriously. Again, this is very much a specific dealer and service department issue, not a BMW issue. As has been stated a multitude of times BMWNA and BMW corporate share no true interest in their dealers.
