I was having the exact same symtoms with my 4.4 2006, and I had the levels replaced but didn't fix my issue, the mass air flow sensor was the problem in my case.

They said that was basically BMW's stance. He said that even if it had been only a few weeks old it would not have been covered by BMW's new car warranty. As BMW said that the lever was within their tolerance range, my aftermarket warranty company (Warranty Direct) obviously declined to cover it. Has anyone else in the UK had the intermediate levers problem? We need to get together to lobby BMW UK. BMW USA seem to have a better grip on the situation over there.
