unlock and jailbreak are 2 different things quick... unlock allows you to use a different carrier. jailbreak allows you to modify the operating system and how it functions.

technically, it was never illegal. just that att and apple could refuse warranty/support on any items that are tampered with.. just like any other electronic device. the intent is to allow more freedom of use like your mac or pc and still get hw warranty/support for it.
