"Void" is a term without any real significance...

The issue is that ANY warranty claim will be denied if BMW thinks a mod was involved. What lay people (ie 90% of the readers here) think is a 'cause' and what BMW and the courts think are a cause are very different.

It is then 'lets play lawsuit" while your car sits in the shop. You spend $40k getting an $8k tranny replaced becuase they claim the increased power due to the flash caused the tranny to fail.

Meanwhile, people say "the flash didn't cause the tranny to fail" and BMW cites test data that shows increased input torque can put more stress on the tranny than the stock torque. Judge agrees.

BMW holds all the cards. Do not think that "they have to prove" will give you any safe haven. The DON'T have to prove before they deny, and in court they have ALL the proof and you have very little. And the vendors for those tunes and mods will be long gone.


Dinan, BTW will step in and pay warranty claims if their device causes the failure. They have a closer relationship with BMW, and, given their prices, can underwrite a more comprehensive claims adjudication process. (They also are pretty 'safe' when it comes to gains.) This and their CA CARB certs are the reason they charge so damn much for their stuff.
