I'm not sure I agree with this. I don't think the average dealer nor BMW NA wants to get into litigation with a consumer over possible software tampering. It far easier for them to simply honor the warranty. Most BMW owners are probably not going sit back while their dealer leaves them with problems over something so pithy.
