I am beyond mad. I am likely through with BMW at this point. Cannot believe they are being this unreasonable. I am on my fourth car in five years. My second new M. I am on the phone with BMWNA now.
Looks like I wont be driving a F10 M5 in 2012 afterall...

That sucks, what was their reason for the refusal?
I don't know exactly how your consumer laws work but over here the liability rests with the selling dealer who have to sort things out with BMW, the selling dealer also attempted the repairs on mine.
I think you need to get legal advice.
