Sorry for your problems with the vehicle.
I wonder how much of the delay in resolution is due to there being three different states involved (selling dealer, licensing state, servicing dealer) and the fact that there are probably a multitude of managers at BMW who each have a piece of the problem, but with none of them fully owning the problem.
It shouldn't matter, but I suspect that in the real world of geographic responsibilities, non-uniform lemon laws by state, and so on, it complicated the resolution path.
I have always tried to buy from the dealer who will be doing the servicing, but I realize that isn't always possible.
