No Xpert on pricing...but neither car catches my eye: no cold pkg, weird nav set ups, etc.
NAV in the older cars is so-so, imo. No Nav would not be a deal breaker for me, as a ~$200 add on does as well, or better than the older nav units.
I would think you could find a few more choices to narrow down, in your area, but maybe not...
Not familiar with that 3rd party coverage; I had good luck with WD, but all are getting pricey. Is the auto trans and related 'electronics' covered? The fine print on what is not covered is the key. And, a car that old may require a pre-coverage inspection by the 'insurer'.
As I suspect you have done some reading here, the litany of 'problems' for both E53s and E70s reads like an executioner's tale. From my following years of posts, yes the auto trans and related electronic glitches are 'substantial', but so are many with few problems. Our manual trans '01 has been nearly prob free for 11 1/2 yrs, fwiw. That manual trans helps the situ, I am certain, but we have had less than a handful of 'minorish', non-maintenance repairs.
Imo, any older E53, (or even an 'older' E70), used with no warranty, is a leap of faith...
I would keep hunting; neither car is what I would want, but it is your pick. And, a thorough PPI by a qualified BMW Indie is highly recommended, though that inspection will probably not be able to predict an auto trans kaboom, within any time frame.
