Let me guess passenger side popping back up?

Open the hood and lube the contact areas of the springs, and the pin that slides in the receiving end by the rad. If all else fails you may have to play with the stops a bit.

Edit: I didn't see that last bit in your post....definitely sounds like the latch is probably toast if you can open it without using the handle from inside the car to "unlock" it.
