Hate to say it, but it sounds like a money pit to me. You could be spending $4900 to buy $5-10k+ in problems. Plus, if you are looking for a commuter vehicle to go 120m r/t 5 days a week, in balmy Texas, I can't say that an older E53 with 200k+ miles on the odometer [getting maybe 20 mpg on premium, at best] is what comes first to mind. I've been very pleased with my X5, but know from personal experience how 'what I like' often trumps 'what I need.' If your heart is set on an X5, keep looking. I suggest a newer 3.0L, preferably with a stick, and without the leveling, etc. options which are just more stuff to break ......
