If its not charging while the car is running I wouldn't risk breaking the key to open it - lot of sensitive electronics in there - get a new master from the dealer if its truly dead IMO

If you have only one key and the battery is dead, I would suggest you to buy new key from dealer first then try replacing battery for the dead key.

Reason is that I've seen many people trying to replace dead battery ending up with broken key that doesn't start either.

I've done several for E39 and E53. It requires soldering skill. Take your time and be cautious.
I have other people sent me the dead key to fix.

Visit www.bmwgm5.com and read the info in Scott's site. The battery is RARELY a problem in the keyfob, usually switches or components coming off the board due to high G forces when dropping the key. DO NOT CUT OPEN YOUR KEY, YOU WILL REGRET IT.

Go find a keyfob tester at your local auto parts store to see if you keyfob actually does not work. See attached picture.

If you need a replacement keyfob, you can check with your local dealer, but most are rapist. Read this thread, about $140 for a new keyfob, it will come precut and will start the car, you will just need to program the keyfob, no tools or software needed.
