BMW X5 Tranny- RRPHIL- HELP Any ideas?

This is for RRPHIL but anyone that can be of help would be appreciated.

From reading your posts you know a lot about bmw Transmissions, I am wondering if you could help please because I am just being messed about and really have no one to turn to.

I have BMW X5 3.0i 2003 with the GM 5L40E transmission I think.

It was rebuild 12 months ago following a oil change the tranny failed garage charged me £1200.
Now it's been slipping, especially in the morning, and gear changes sometimes are really rough (rear ended). Trans fail safe mode twice- but re-started and it resets. The garage read the code (RGC Transmission- Morley- Leeds) and said BANK 2 code meaning that it does not like gear 2 or something to that effect. Phil they are saying the problem is NOT MECHENICAL and something else is causing it and will say it's out of warranty now.
I can not throw more money at it- just cannot afford it anymore- Any help you can offer would be great.
