Salesman lied when I bought my X5?

My X5 was CPO at a dealer in WA.
I asked the salesman "Did the car involve in any kinds of accident?"
He said no, only did a few services at the dealer.
yesterday someone from roadfly M3 forum helped me to Carfax my car.
mn.......something interesting....

Bad news!

I don't feel 100% safe driving my X5 anymore. You know what I mean.

I need to keep this car for 3 more years.
any suggestions?
Should I have the dealer re-check the car? or anything

From my understanding of things because your car is CPO you have recourse with the dealer! - The fact that BMW gave your car a CPO means that they should have checked that. Mine is a CPO as well, the dealer told me clearly at the time "The fact that is is CPO you can rest assured that it has not been involved in an accident...."

Note that the CPO guidlelines do not require that the vehicle was never in an accident, but must not have incurred damage to the unibody structure. See http://www.bmwmotorsports.org/pdf/BM...guidelines.pdf on page 10 for more details.

Now if they lied to you and flat out told you that it was never in any accident then I would go back to them and ask for an explanation and compensation.

I'd beat on'em for sloppy or lack of disclosure...
imo, the avg or even, above-avg Sltr does a very cursory "check" running his finger down the "CPO audit" list: 15 mins of "looking", a quick detail and it's on the lot, for sale. My 2Cts. GL,md

I'm certainly not an expert, but I doubt if being CPO has anything to do with being in an accident. It seems a properly repaired vehicle would easily meet CPO criteria.

Accident was the major concern for me before purchasing the car.
I didn't know any sources to check the history other than the dealer.

I am just not happy that the salesman lied.

I could probably understand a Minor bumper bashing, but when I read on your report there that you had Airbag Deployment.... that changes things quite a bit!

Either way I would defiantly have a good chat with your dealer

I am very surprise that a car could be certified after a crash, but it may not have been...If I buy a CPO car from a dealer,and then let's say get involve in a crash and a year later trade it back in for an other car, my original car can still be sold as a CPO since the CPO warranty is transferable from one owner to an other. I have got to say though, one should always check the car history before buying, any dealer will give you a print-out upon request....

I am a dealer in Canada, dealer by law has to tell you everything about a car, if the car was in the accident, and if it is not indecated in the bill of sale, you can return the car or ask for some money back or sue the dealer for everything. Any staff about the car, the rental, taxi, ex-police, theft recovery, accident, frame damage, odometer reading needs to be reported to the buyer in writhing. If he even tells you the history of the car, and it is not in writing it can back and hunt him. If you sell the car as private, you dont have to do that. Plus before every sale dealer has to get the history of the car from Ministry of transportation, or DMV.

This just makes me mad! The dealers can pull a Carfax report and I think they took advantage of you not knowing about this. I hope noone on the site takes offense to this but in my personal experience I have yet to find one honest enough to tell the truth and not be concerned with the almighty "sale". I have found Carfax to be my best friend when searching for a car and have avoided a number of bad cars. The dealership always looks surprised when I inform them that the car has a problem. That part is kind of fun for me. :p

Sorry for you problem with the dealership and I hope you can get something done about it.
