warranty / wiper motor ?????

I have a 2005 X5 with 45K miles(still under factory warranty)The front wipers stopped working so I took it in. The dealer called and said they took the motor appart and the tech "filed" new teeth in to it. Since I live in North Michigan they said it is NOT covered under warranty and I have to pay $250 for their fix. DOES THIS SEEM RIGHT???

also, to note the wipers worked early in the day and then just stopped with no ice/snow build up. And the dealer said they fix this problem all the time. sounds like a defect in design. I have never had this happen with any of my cars. even ones with 200k miles!!!!
