i don't post much but i'm on here reading alot. here is my story last saturday when my wife was taking one of the boys to basketball. some a hole in a truck decide to try and beat the light. he didn't and stopped with the X5. everyone is fine but the truck took a nasty his to the passenger door the fender and suspension. the curtain airbag on the pas side blew. i send the truck to the shop the estimate was around 14k. i just got a call from the idiots insurance saying he only has 10k in insurance coverage. so now i only get 6k because he hit another car. the 6k will only cover the parts. so what do i do my truck only had liability since it was paid for and they wanted 3k a year to ins. alot more than my vette. so i when with liability. after i try suing the guy and his company i will part out the X5.

You need to put the claim on your insurance (it doesn't count against you) and subrogate against their insurance. Ask your insurance company if they will do that--most will. Your insurance will go after theirs meanwhile your car is getting fixed. Most big will insurance companies will do that because even if they lose the $ loss to them in the big picture is such a small percentage they just write it off.

In his original post it sounds like he only had liability coverage from his insurance company. I am not sure then if his insurance coverage would cover the gap of what the guys insurance would cover. May have to sue the guy to claim damages?

He needs an "uninsured motorist" coverage to file a claim with his insurance company in this situation.

I wouldn't get liability coverage only on a car that costs a lot more than insurance coverage. bd3500 is right, he may have to sue the guy personally.

Glad to know that original poster is OK. Thats why you have full coverage on a vehicle expensive to fix. 3gs a yrs isn't much when 1 hit can cost well over 3gs.. but hind sight is 20/20 i guess.

yes if you have collision on your car your insurance will pay the full cost of the repair..then you must sue or your insurance company will sue the other party/insurance company to recoup the money..especially if it is totally the other persons fault..read accident report..but in the meantime your vehicle should be repaired fully minus your deductable..deductable is your only out of pocket responsibility and a good body shop will absorb most or all of it in the estimate..
