Loser alert "ftara"

I may be out of line here, but feel the need to protect others.
Alias named "ftara" contacted me about a Mark III drive i had.
Sold it to him on the cheap. $225.00. Turns out he was throwing parts at his problem or something. Decides he doesn't want it. I refused to take it back since i hadn't marked it or had no clue if he installed it wrong and may have fried it. Well this turd filed on me with paypal. They ruled in my favor, so he took it up with his credit card company. He said he never received it. Total lie and fraud. I have P.M.'s detailing this transaction.
To top it off, his credit card ruled in his favor & now i owe him $$ & he has the unit. Wow ! Unbelievable! Any advise on what i can do?

do you not have a say with his credit card company? you can get him for credit card fraud--not sure if there are any damages you can claim for yourself though..

might be worth talking to a lawyer

You might want to contact PayPal to see if they have any sort of Seller protection that will aid you with this. Given the documentation trail that it sounds like you can produce, it clearly sounds like a case of fraud to me.

nothing you can do...i have been burned like this twice.

set up your PP NOT to accept CC. only paypal cash value.

i was ripped of for about 6K this year alone. pretty common scam

I thought that if it goes through Paypal, all resolutions must go through paypal and the CC company should not interfere. Paypal acts as an escrow account. The CC company should deal with paypal, should they choose to.

I had a real issue with a seller once and used a CC through Paypal. My CC said they couldn't do anything about it and that Paypal had the final decision.

You have 0 recourse now through PayPal or the buyers credit card company. The buyer paid you through PayPal using the buyers credit card linked to the buyers PayPal account. PayPal handled the claim properly (they are always in favor of the seller) but they have to yield to the buyers credit card company.

If you have tried to work this out with the buyer and they refuse to ship the item back to you (buyer needs to cover shipping) then I would consider this fraud. Theft. ie: it appears the buyer knows what they are doing enough to get the item and not pay for it. This by itself is basic THEFT.

Since you have the buyers address you will need to file a police report with the police department where they live. Explain to them truthfully that you shipped the items to the buyer. Provide tracking information. Provide them where the buyer then reversed the payments.

If the buyer is in a different state it gets really ugly because of crossing state lines there might be a possible extra issue there.

#1 Always try to work the issue out with someone before loosing your cool.

Send the buyer a email tonight explaining that you want them to ship your parts back to you at their expense.

If the buyer refuses explain that you intend to file a police report based on the fact you shipped the buyer functioning goods and they received them then pulled the money back. So now they are holding the money and the items.

After that it will be out of your hands and you will need to cease contact with the involved party and let the law handle it.

If you do not want to get the police involved at this point you can always file a small claims case in the county which the buyer lives. You can sue for the item, expenses of their fraud and the court costs.

You will need to call the court house in the city of the county the buyer lives in and they will mail you the claim form for the state. You fill it out mail it in with certified funds for the court costs and filing fee. The buyer will have to answer the claim if they do not you will be awarded a default judgment. At that time you can then file for a garnishment of wages and the party will be forced to pay the money to the courts and back to you.

Again - there are two sides to every story so I am not siding with anything or anyone.

However, this will be your only actions left to recover the items or the money in any situation like this. Not just you and this one buyer. I am not a attorney -- nor do I represent myself to be one. I am offering my .02 cents which is about all that this is worth.

Paypal just changed their story. The first told me that is wasn't received...now they tell me the guy said the unit showed up missing 5 wires and 3 plugs.
I took a picture of it right before it was removed. Date & time was showing.
interesting, as we all know, there are no exterior plugs and there is not 3 plugs to be missing.
Bottom line is i paid the 245.00 to paypal and accepted the fact i was just f*cked by some jerkweed and have no leg to stand on since his CC company accepted his word. Thanks for all your support and i advise not accepting paypal payments from people you aren't sure of.
