Question Newb here with my first post and some?'s / Need advice

Hello all! I recently (last Saturday) purchased my first E70, an 09’ X5 4.8i with 96k+ on the odometer for my wife that is expecting our first child. My wife and I are VERY excited about it, however it’s been a bummer that I haven’t been able to play around with it very much because I haven’t received it back from a Houston area BMW dealership that I demanded work on it due to the fact that I was only willing to purchase the vehicle from my local GMC dealership if they allowed me to take it home Friday night and go over it with a fine tooth comb to make sure that I wasn’t being rushed into purchasing a lemon. I’m sure you all understand. We've had family members that’ve owned X5's and they advised us what to look out for which was a tremendous help. The main reason I requested the dealership to work with me on this deal was because out of the few things we initially noticed at the dealership Friday night before we even test drove the SUV was that the lift gate in the rear of the vehicle did not open automatically, which I thought it should (due to comments I’ve seen on forums/online) with the push of a button using the key itself or a button that is located on the bottom of the truck lid when opened. I also believe there is a button on the dash of the interior that is supposed to automatically open the trunk hands free. Please correct me if I’m wrong, but from my understanding this option was incorporated into all X5's beginning in 2007 from what I've researched. Also, I noticed the video/navigation screen on the dash was showing the Passenger Restraint System error message, so I wasn't sure if that was an electrical problem or what. Next, once we started driving an indicator light continued to keep popping up regarding low tire pressure on the right rear which ended up being a bad TPMS sensor according to the general manager of the GMC dealership. On top of all of those problems, Saturday while I was at work my wife pulled the X5 out of our garage to find some fresh new oil leaks that were never there until we parked it in that location. This problem was “supposedly” diagnosed by the GMC service manager once we brought it to their attention Saturday evening when I got off of work. He claims that the oil valve wasn’t tightened properly when they serviced the vehicle there at the GMC service shop when they initially received the trade-in. As minor as the next problem was, there was a grasshopper/bug in the passenger headlight that was promised to be removed due to my wife freaking out over that. So the main concerns of ours are: 1st the oil leak, 2nd the automatic lift gate problems, 3rd the passenger side airbag issue, 5th the headlight, and last but not least, I figured the vehicle needs to be properly serviced and gone through by BMW because on the dash in between the speedo and the tach there is an indicator that stays on. It’s in the shape of a triangle with and exclamation mark (similar to the hazard light button on the dash). If any of you e70 fanatics/enthusiasts can please weigh in on these issues that I’ve noticed and have any ideas, thoughts, or opinions it would be INCREDIBLY HELPFUL and APPRECIATED by my family and myself. I’ve always loved the E70’s but the reason I wanted one was because I need my wife and newborn to be in the safest and hopefully most reliable SUV that I could afford to put them in. Once we get past these issues I want to start adding some tasteful mods but I will save those for another post. Not all E70's have a powered liftgate.
Go to bimmer.work : VIN Decoder for BMW and put in your last 7 of your VIN. Does it say you have a powered/automatic liftgate?

You need to assume everything the GMC dealer is telling you is a lie.

I would NOT assume they fixed the leak- just steam cleaned the engine or maybe masked the issue, hoping you will buy their story until its too late.

Have the BMW dealer go through and give you a written estimate/repair- then tell the GMC dealer 'take this off the price'. Or even better, tell them 'have BMW fix it' then I'll but it. (The latter protects you if the BMW dealer got the estimate wrong and they find something worse when they go in.)

The X5 is NOT 'the most reliable vehicle you can buy'. Im a fan, but its a car with foibles like all others- more than average too.

You and I are MUCH alike ARD lol! EVERYTHING you mentioned I made sure was all written into the contract actually. I didn't trust the general manager of the GMC dealership as far as I could throw him! So long story short, I had the GMC dealership transport the X5 (because I didn't want anymore miles on the odometer) to BMW of Clear Lake which is located right outside of Houston to make sure ALL the repairs where done properly by a trained/official BMW technician and for them to do a full pre-purchase inspection on the vehicle all on the dealerships dime. Along with that, I also requested to receive all the original documentation/receipts of everything that was repaired and inspected in order to know what I should be weary about. I tried to cover my rear end on this deal because I had already gotten the price of the E70 down to my original offer, which was 7 grand below what they were attempting to sell it for. AND that's including the best warranty I could get for that year/mileage X5 along with tax/title/license. So... I'm hoping to get the ride back today due to a part the BMW dealership has been waiting to receive in order to fix the lift gate issues. Thank you for your advice/insight!

Well... Everyone, I went over the general managers head of the GMC dealership today and personally called and had a nice lengthy conversation with the Service Manager of the BMW dealership that the X5 is being held hostage at. Along with speaking with him, I also was able to chat with the actual service writer that is dealing one on one with my particular E70. I was finally able to get some questions answered and even received a bit of good news with it as well. With that being said, I was informed of other things that hadn't been brought to my attention by the GMC. While the BMW dealership was able to correct and clear the passenger restraint codes as well as go through the vehicle and track down where the oil leak was coming from. Surprise! Surprise! The local GMC dealership that had originally told me the oil leak was due to an oil cap not being screwed on tightly after a service that they had completed, which was one of many red flags that initially went up for me upon inspecting the SUV. I was then informed by the service writer at BMW that the oil leak was coming from what I understand to be an alternator gasket, if I'm correct? He claimed it was a fairly common but yet very minor issue to be fixed/corrected. Has anyone experienced these problems with that particular issue before? The good news is that the trunk liftgate is finally finished because the part came in, however the gasket leak should be completed tomorrow (Thursday). With this new information at my side, I decided to go ahead and contact the general manager at GMC and play dumb looking to see what lies he had in store for me next. He claimed that he had already attempted to call BMW at least twice today with zero call response, which I found to be a bit strange for some reason. It was then that I informed him of the conversations I had JUST had with both, BMWs service manager and the service writer in charge of my personal X5. He responded by saying that he was planning on fixing the oil leak upon its return to his dealership, & not having it fixed at the BMW dealership. Which my wife and I were both under the impression that BMW is where every thing was going to be repaired properly by certified BMW technician. He then went on to say hmmmm... So, what did they tell you? I wasn't going to spill the beans just yet to him in regards to what they had relayed to me because if he had in fact been in contact with the BMW dealership over the past nine days like he said he had been, he would've known about this issue already. I was already incredibly frustrated/furious to say the least! So as I tried to maintain my composure with him & I reminded him that upon my request while going over the numbers of the vehicle and the repairs that I had requested to have fixed all by a certified BMW technician (going on nine days now), it was then that he admitted to the fact that he told BMW that his top technician at GMC would take care of that particular oil issue. Due to the fact of how I originally got him so far below his asking price and by the time you add in all of my request for repairs etc. I now know for sure that this particular GMC dealership was trying to hustle some poor soul and I happened to be the wrong one to walk in that day, coming from a sales background as well as being very involved with business activities and my day job as an accountant. Luckily for me, I have family connections who were able to get me the original price that GMC had originally purchased the X5 for at auction, so I'm now fully aware that just with the repairs done so far, the warranty, along with the tax/title/license that the dealership is now losing between $6,000 and $7000 on me due to trying to pull one over on me lol. That's unfortunately what they get and deserve for trying to do bad business like they are. Due to the incredible price that I've gotten them down to, it's very hard for me to turn my back on this particular ride (because my wife loves it), but do any of you enthusiasts that have experience dealing with these issues have any advice for me moving forward from here? I told the general manager of the GMC dealership that upon the arrival of the completed/repaired X5 (if up to my standards/expectations) and pending the condition of it after my wife and I take it for a couple of days to further inspect it and to once again have it taken to a different BMW dealership to have them do another pre purchase inspection on it that I am more willing to pay out of my own pocket to help save me money in the long run and to give me a better peace of mind. So I'm begging for any of you E70 lovers / pros experienced with the E70, if you have any ideas as to what my next move should be in this chess match between myself and the GMC gm? PLEASE FEEL FREE TO HELP ME OUT!! I'm all ears at this point before I get taken for my money! Thank you all for your time!
