I've seen loaded 07's 3.0 with 10K miles for 40K and loaded 08's for about 45K.

I bought my 07 3.0 with the sport, premium, ipod, rear climate control for $39500.00 and that included the CPO. Their are some great cars to be had on the used car market. You just need to take your time to find them.
I would agree with you in a normal economy. That is how I bought my CPO '01 X5. However, the CPO market is the only one doing well (USA today article). That is why I bought new this time. In November, I paid $51,000 for my '09 3.0 that had a MSRP of $55,925. I am fortunate that I have many dealerships in Southern Cal. I bid the car out on-line through 5 dealerships internet departments and got the deal (they were desperate). Also got .9% financing through BMW.
Now BMW is also paying the first two payments up to $750/month(additional $1500 savings) on new cars.

Great idea, but since I'll be leasing, I will probably still get new.
