Another Transmission Reprogramming Question

I called the Service Manager at my local dealership and we discussed the lagging transmission response with my 2008 3.0. He said that there is a fix, but BMWUSA will not always give him approval to do it. He says that BMW will tell him that the car was designed to run that way. Doesn't it sound ridiculous that if there is a fix to make the car shift better BMW would want to do it? It seems like the car is always in the wrong gear and when you step down on the throttle when you go around a corner, there is nothing there until you push it all the way to the floor and then you jerk everyones head off. They are suppose to check on it tomorrow to see what they can do. Any suggestions?? Thanks for listening again......
