Newby and buying soon

I have been an E46 fanatic for some years and love how the BMW community helps itself. My wife will now jump in and spring for an X5. We are looking at late model (08-10) and using Edmunds to help with value pricing.
I am looking at a 2009; 36K; 35D; with cold weather package. It would be a private aprty sale and with a clean carfax. Is there much risk in buying this X5 still under warranty if the one owner seems pretty legit? The price is $33K and seems a lot better than a dealer with certified but it would be more risky.
Any advice on the price would be helpful.

Another option would be to see what it would take to get the X CPO'd by the local dealer...may be worth the time, $$ and effort.....if you have a good relationship with the service department it may be worth a try.

Not knowing anything else about the car, I think that's a good price. We bought an '11 35d in Fed but were shopping 09 - 11.

Whats the in service date?

Thank you for the response. The dealer wouldn't help, said the service history is for BMW eyes only.
I feel kind of stuck because I can't get a build sheet or service record as the owner does not have them.

Go to a different dealer. All ou really need is to have them pull p the vehicle via the vin and read off the info -- build info, in service date, service history.

Or, since this is private party, have the owner do it. They want to sell the car, right?
