Someone hit my 2013

Ok, so less than 2 months of owning my new 2013 x5 SAV and I get hit in one of the worst places ever. Driver side rear wheel straight on (les than 10 mph). No body/paint damage but here is whats F'D up from what I noticed: Driver side rear wheel, alignment issues, error code "suspension malfunction", HDC and Parking Brake buttons both don't work anymore.

Car has been flatbedded to BMW Body shop near home and awaiting final damage report later today. Here are some questions if any of you can help...

How bad does this sound? Is it possible to get additional depreciation money for now having a car with suspension/frame work? If they offer to "repair" instead of replace, do I have grounds to fight to have new parts including the new 20" damaged wheel/tire?
