I have not yet had to deal with this problem but I did ask a technician a while back what problems I should expect to see with my vehicle down the line (it's a 08 model so getting on a bit) and he said that the electro - mechanical park brake is one of those unfortunate eventualities most 7 series and x5 owners have to contend with. As for almost never using the park brake...maybe you almost never knowingly use it but to my understanding it ALWAYS engages once the vehicle has been turned off as a default safety. It is after all the law. It can be manually disengaged from inside the boot as explained in the owner's manual.

Perhaps different in the states ARD but I've made a point of checking mine. I'll engage Park then turn off the car (in my garage where it's nice and quiet) and I clearly hear the park brake engaging. To confirm this, when the ignition is turned on. The park brake light is on. I've tried it a different way too just to be sure I wasn't shooting my mouth off. I engage park and turn the car off with a single press...radio still on as are all the dash lights. Open the drivers door, taking my foot off the brake and sure enough I hear the park brake engage and the park brake light on the dash comes on. As I said, perhaps a difference between the states and South Africa though the way we do things here I seriously doubt our laws are more stringent than yours.

^ Interesting. I'll bet it is a programmable/coding feature.
I never use the parking brake in the garage. My wife always does. So if I get in the car I know immediately which one of us last drove the car: me, it is shift out of park and move. Her, it will not shit out of park and requires the ebrake release first.... |

I honestly agree with ard so much, it wasn't beyond the realms of possibility to fit a handbrake, I've got one in my DD with the SMG gearbox. Just irritates me so much and now the damn things broken. My X5 doesn't engage the parking brake everything you turn the engine off, maybe it's just in South Africa?
