This is really something new to me. My wife's car (2000 528i) needed a smog check. So I brought it to a smog shop yesterday. As soon as the Tech open the hood and see's that I have a CAI. He already advice that it will not pass the smog unless I put back the OEM. He said that this is the new DMV law?

Just wondering.

That may very well be a DMV law in you area. Those rules are made up state by state. Your state may require only OEM parts on the car to pass inspections.

Would it fail a test, probably not, but it fails their OEM test.

State to state laws.... however simply looking and saying that is BS. There are CAI's that are smog legal. There are so many modified cars in Cali, I find it hard to believe this would be the case. If it is though, toss the stock back on, inspection, go back to cai if you like it. Total of 30 minutes to remove and replace.

I agree..It is BS. If the law states that, then thats one thing. But I bet the CAI would pass the smog test....

I totally agreed with you guys....I did put back the OEM this morning and took it back to the shop and pass it. After that car went back to the garage and reinstall the CAI.
K&N Air filter is approved by DMV and a couple more name brands that we can purchase @ the dealer. I was hoping to have my x pipe replace soon but that's going to be in the back burner. Anyway thanks guys.
