Need Advice/Help: Pitbull Killed my Maltese
 

It's not my maltese, it's my mother's. She lives in one of those massive condo units, very luxurious. Her maltese was in her patio playing when one of her neighbors pitbull jumped into the patio and attacked our maltese, ultimately ending his life.

My mother is in panic, I'm not sure what the process is. Do I call animal shelter/services? I called them but their lines are forever in hold. Do I hire a lawyer because I want to sue the f*** out of that neighbor.

Unless there was some blatant disregard and previous violence from the dog, you probably can't "sue the fooker".

Call animal services and report the incident. Hopefully there was some type of witness so it isn't one persons word vs another. I would start documenting the patio, the fence the dog jumped, etc.. to get to the other dog. You should also start documenting any known other aggressive behavior by the dog, interviewing neighbors etc.

You need to build a case, unless there are pics/vid of the attack happening. You can't just say "that dog did it".

Hang on, don't get excited.

There is a police report that will be important - an investigation could be necessary. Let them call animal services. Do your homework and register this with the police as the starting point.

Write a police report. Then report the dog and make sure it goes on the: Dangerous dog list

I would suggest to the owner of the Pit Bull that they have the Pit put down. I would also call a lawyer.

(And I don't suggest that the Pit be put down because of eye for an eye.. BUt because that Pit is clearly dog aggressive and poses a threat to every other dog in the neighborhood.)

I would also report it to building management and the buildings insurance company. At the very least, I'm sure you can have the dog evicted from the premesis.

And you can sue the owner.. Dogs are considered property and your mother has suffered a financial loss. You can also make a claim for punitive damages and negligence..

But no money in the world will bring your moms dog back.

Take lots of pictures. as hard as it is. Report it, report it, report it.

I can almost promise you that the owners of the Pit will not take the proper steps to deal with their aggressive dog.. It's up to you.

I agree with B, I would call a lawyer, find out how much you can sue for and go for the maximum. Personally if I had seen my dog attacked/killed I would have tossed the dog over the railing but that is just me being a dad. I'm surprised they allow Pits etc in your building. We recently revised our pet contract (I sit on the board) to specifically exclude certain sizes/breeds to prevent this type of thing from happening. As of 2/1 several breeds (including Pits) are banned from our condo building or any community property. First off, calm down and don't do anything you will regret. Call the police, file a police report and have the dog taken into custody. I would move to have it swiftly put to sleep and then work on a lawsuit against the owner. Once completed I would recommend the building move towards putting restrictions on breeds, sizes etc to make sure this doesn't happen again. A good way to go about getting those type of breeds etc banned is by threatening to sue the building unless their policies change. We had a close call here and that is what landed the changes.

I hate to say it, but I hope people listen to the things B and I have said on this forum. Those dogs, no matter what the owners on here will lie to make you believe are NOT fit for homes or condo buildings. Their a danger to society and the people their owners force to be in contact with them. I have believed for a long time (and enforced) a new Pit policy for my dog. He isn't even allowed to sniff them, that is how serious I am about it.

Do you have to flood this with your personal horse_hit? I mean it was enough to say "I agree with B" then you throw in your bias personal opinion. I actually knew this would be here before I opened the thread when I saw your name :tsk: He asked for help with the situation, not "Hey, anybody have a completely uneducated response?" Sorry man.
