Need a little advice
Hey guys, just wanted some opinions on what to do. I got 1st floor renters who has a car basicly stored in my drive way area. Its out of the way and not causing any issues but the family went to another country for business purposes. I believe the daughter is still here with another family living in the first floor. Car has been there for like half a year now and my dad says they dont want it anymore but don't have the title so they and we can't sell it. My idea was to contact the owners through the daughter for them to send a ID for us to fill out a recovery for a title and than we could take ownership and sell the thing or just get rid of it. is there anything else i can do? dad was about just say that the owners dumped the car here and let them tow it but i don't want the daughter to get into trouble since they pay rent and they don't cause any problems. any advices on what to do with the car? Thanks!

Half a year? That's a long time. I would definitely go through the daughter to get to the owners. If they have the title I think they can just sign the back to transfer ownership to you.
Are the owners of the vehicle still on the lease/rental agreement? If they are no longer tenants in a legal sense (ie. they have a right to occupy the residence) then anything they left there after whatever period NY law prescribes before property is considered abandoned, is yours to dispose of. Also, code enforcement might have something to say about it as a nuisance. On the hand, if they pay regularly, and the car is out of the way and not a hazard, just keep collecting rent and live with it. |
Any clause in the lease agreement regarding storage specifically cars? Is the daughter on the lease?
If the lease agreement allows it and the parked car is not bothering you may be you can ask them (the daughter) to pay for car storage. I would be very nice about the whole thing since you say they are paying tenants. |
Thanks for the comments, they are paying still and they just asked nicely to store the car while they were away, it is out of the way and not a hazard though the tires are completely flat and i don't know how safe that car is after not being used for 6+ months so i dont think i want to try to sell it if they allow me to. But i am gonna keep talking to them and see what they wanna do, if i can't sell the car maybe ill just sell it for scrap metal and make a buck =D which of course will go into the X hehehehe hopefully not repairs lol

Given that condition, "Nuisance" as in people are complaining is probably your best avenue of conversation, as your relationship is still mutually important and 'time' and 'ugly' are definitely on your side.

If u can't sell it u can always donate it. They don't need the title.
