Saw something yesterday that concered me...

(yes, I found a computer at the hotel )

So I was driving in my rental ('08 Ford Escape) to In n Out (Carlsbad) when a crown vic pulls out. I think i'm totally bused, (since I'm going 10 over the limit like everybody else), but no, he pulls over a slow moving F-150 with a cracked taillamp. Driving past them, I see the driver and passenger were both mexican. So why pull over the pickup that was going the limit for a minor infraction, insted of me, who was slighly speeding? Obviosly the officers wanted to deport some hard working landscapers or farmers. They weren't even Border Patrol! Very wrong to me.....

Anyways, having a good trip! Chilly, but whatever. Going up to LA tomorrow.

(And drive safely, because just as I was going to exit the 5 last night on Via de la Valle, I saw it was flared off, and about 8 firetrucks were putting out a fire on a pickup, which had rolled over. Alcohol was involved.
So drive very safely!!!

Well, we do have a problem with the border but that is a different topic and issue.

I am sure things like that happen in Chicago, NY, LA, etc.

I used to see racial profiling in the suburbs in Philly all the time....especially on the "Main Line" section.

This is the first time I have ever seen anybody pulled over solely because they were illegal. And the cops took a risk assuming they were, and they could have gotten me with out a problem.....but I guess this is just part of societly.......oh well...

How did you know they were illegal? and how did you know the reason the CHP pulled him over?

actually, having just studied crim pro last semester, i can say that racial profiling was actually upheld in recent supreme court cases whose names elude me now. this doesn't mean that the usual dissenting suspects (i want to say scalia, as usual, but i can't be certain) didn't voice their strong opinons to the contrary. indeed, a law professor at georgetown wrote a famous rebuttle illustrating with hilarious detail the absurdity of racial profiling, essentially showing how ANYbody can be subject to racial profiling.

simply put, at least from a criminal procedure legal point of view, racial profiling IS ok if the totality of the circumstances gives rise to reasonable suspicion.

Moreover, if the driver of the truck had a cracked tail lamp, and esp if it was nonfunctional, then that alone is sufficient for a traffic stop. That the traffic stop was merely a "pretext stop" -- e.g., one used as an excuse for the cop to discover any other unlawful affairs -- is also not unlawful.

So however you slice it, the cop choosing to go after that guy in his pickup was by no stretch of the law without merit.

On principle alone, I agree with you: he SHOULD have gone after you. That he chose otherwise does not, however, put him in the wrong. At least not legally.

Man, how I love/hate legal reasoning at times.

Well, anybody could have guessed. A old pickup, mexicans dressed in not so clean clothes, and then sitting on the curb with handcuffs on a half hour later. It was the Carlsbad, CA PD that pulled them over. I was right behind him for maybe ten mins.

First let me state that I think racial profiling is wrong.

I personally love the fact that we have such a diverse group of people here in the USA. It is what makes up the fabric of our country. My wife is Filipino, her family came here before she was born.

But her family came here LEGALLY. I know that most of the illegal emigrants are hard workers and most are good people. That still does not give them the right to enter our country illegally. We pay for their medical care and education with our taxes. They steal our identities and ruin our credit. The solution is to make it easier to come to our country. I have no sympathy whatsoever for someone here illegally.

I should not have to suffer for them breaking the law.

ahh, that right there is a reason to be pulled over and DEPORTED.
