Question Insurance question

OK, here's the deal. Although I filed the claim with my insurance company, he has ample coverage and is 100% at fault so he pays my deductible. Do MY policy limits still apply regarding the replacement rental? My policy has $40 per day max 30 days. My car rate is $38.89 per day plus taxes. My insurance company is being billed the $40 per day, I get the balance of a few bucks per day. Two questions;
- If the repairs exceed the 30 days is his insurance company responsible for anything past the 30 days
- Can I get my out of pocket for the daily rental rate from his company?

Since it's his fault, shouldn't his insurance company also be paying for the rental car? Which means, if repairs exceed the 30 days, they should be the one paying for it?

I don't know, manuals aren't the only thing I don't read :

That's what I'm thinking. I need to ask my insurance guy Monday.

Michigan is a no-fault insurance state, which means your own insurance company handles all your bills and then settles up with the other individual's insurance carrier if they were the one at fault in the accident.

In a nutshell, a lot will depend on your state and how the insurance companies do business in that area.

I don't know. Barring anything unforeseen *fingers crossed* I can get her before I go back to work Monday 8/20. If that's the case I'm cool. The "unforeseen" concerns me.

I hope so!

Did they end up finding any more damage than first suspected? It usually happens after they take apart the car .........

Not yet, I'm waiting to hear on the differential. Fighting on that one. They said they'll know when they get in there. They're still waiting for a part.

Actually, because your car is a "luxury " vehicle you should be entitled to an upgrade luxury car for the entire time your car is disabled.

You are out due to his negligence and should not have to suffer driving a KIA while your BMW is in the shop having major surgery. Your insurance company should have informed you of this at the time of the incident. You pay them good money and they should make sure you are treated right.

Now had you been at fault you would only be entitled to your coverage limits which is $40...Because he was at fault HIS company should place you in a comparable loaner/rental vehicle.

*crossing fingers* I hope they just give you a new differential. I'd be more than upset if they gave me back the car, and 200 miles later the car started driving funny
